Stand your ground law applied to Iowa case

MARION – It is the first time the new law is being used since it was put on the books.

The case involves two men, Samuel Gire and Matthew Boleyn. Boleyn allegedly charged Gire’s care and broke his window a few weeks ago. Gire feared for his life, so he shot Boeylyn.

After investigating the case in recent weeks, Marion Police say Gire was acting in self defense. They cited the new “stand your ground” law that was passed by lawmakers earlier this year.

The law broadens the definition of what “stand your ground” is, and when it can be used in cases. Stand your ground means that if you feel like your life is in danger, you can use deadly force, like shooting a gun, in self defense.

The new law says you can defend yourself with a gun in “any place where the person is lawfully present.” so any public place.
